How We Work

A property transfer has many moving parts: the signed offer, clearance certificates, bond and cancellation figures, and the final lodgement at the Deeds Office. We manage every one of them personally. We draft the documents, liaise with the other conveyancers involved in your transaction, including the bank's bond registration and bond cancellation conveyancers, and keep you informed at every stage. You deal with one dedicated contact from start to finish, not a call centre. Registration is completed through our appointed registering conveyancer, so your transfer is lodged and finalised correctly and on time.

Selling or buying?

Consider this when

If you are selling

  • 90 days' notice - Give your bondholder 90 days' notice of cancellation if you have a bond over the property.
  • Settle outstanding accounts - Settle any outstanding rates, levies or municipal accounts before your transfer; unpaid amounts will hold up your clearance certificate.
  • Compliance certificates - Have your compliance certificates ready early: electrical, and where applicable gas, electric fence and plumbing. These are needed before registration can proceed.
  • Cancellation figures - If you have a bond, cancellation figures need to be requested, and your final payout depends on when that cancellation is finalised, not on the transfer date alone.
  • Respond promptly - Respond to document requests promptly. The single biggest cause of delay on the seller's side is paperwork unsent or unsigned.
Consider this when

If you are buying

  • Get pre-approved - Get bond pre-approval before you make an offer. A transfer cannot proceed until your bond is formally approved and guarantees issued.
  • Budget beyond the price - Budget beyond the purchase price: transfer duty, bond costs and conveyancing fees are separate costs you'll need to plan for.
  • Expect bond approval to set the pace - The timeline runs on the slowest moving part, which is usually bond approval, not the paperwork itself.
  • Notice on tied-up funds - If any of your funds are tied up in a call or notice account, give notice in good time.

Do you handle conveyancing in Table View and Blouberg?

How long does a property transfer take?

Most transfers take between eight and twelve weeks from signed offer to registration, depending on how quickly bond approval and compliance certificates come through. Cash transfers can be faster: we aim to register within about a month of receiving the required funds and documents, and bonded transfers generally within six to eight weeks, if all parties cooperate.

What does conveyancing cost in Cape Town?

Conveyancing fees are based on a sliding scale linked to the purchase price. We give you an exact, itemised quote upfront, so there are no surprises on the final statement. You can also estimate your costs with our transfer duty and bond calculators.

Who pays the transfer costs, the seller or the buyer?

The seller usually pays the estate agent's commission and the cost of cancelling any existing bond. The buyer usually pays transfer duty or VAT, the transfer legal fees and Deeds Office fees, plus the costs of registering a new bond. The offer to purchase can agree something different, so it is worth having us review it before you sign.

Can I choose my own conveyancer as the buyer?

Yes. In South Africa the seller usually nominates the conveyancer, but as a buyer you can make your offer subject to your own conveyancer handling the transfer. Not all sellers accept this condition.

What happens if there's an existing bond on the property?

We coordinate directly with the bank's appointed cancellation conveyancer, so the existing bond is cancelled in step with the new transfer and bond registration. This runs in parallel, not after.

Do I need to pay transfer duty?

Transfer duty applies on most purchases above the current threshold, calculated on a sliding scale. We'll confirm the exact amount, if any, once we have your purchase price.

When do I get possession or the keys?

Possession is set out in your offer to purchase and is a separate arrangement from registration — it can happen before, on, or after registration date, depending on what was agreed between the parties.
